The court of appeals held that it did not have jurisdiction over Armando Quintana Villanuevas appeal from the trial judges decision to deny his Article 11.072 application for a writ of habeas corpus as frivolous because the trial judge refused to consider the merits of Villanuevas claims. We reverse the court of appealss decision and remand this case so that the court can determine whether it has jurisdiction to consider Villanuevas appeal under Article, 11.072, Section 8, which governs the right to appeal.
